NEW CA LAWS PROTECT EMPLOYEES’ CRIMINAL RECORD, IMMIGRATION INFO, PARENTAL RIGHTS, AND MORE
As of January 1, 2018, California employers received a new set of important legal restrictions and regulations, including:
- Employers may no longer ask applicants about their salary history. When you are applying for a job, an employer cannot ask how much money you’ve previously made or currently make in order to make a decision about how much to compensate you if they decide to hire you. This also applies to other compensation, such as housing allowances, insurance coverage, and other benefits.
- Employers cannot actively participate in the immigration enforcement process. This means that attempting to verify employment eligibility via methods or questions not included in Form I-9 is now considered unlawful. Your employer also may not permit immigration officials to enter private workspaces or access an employee’s records unless they have a warrant or subpoena.
- Employers cannot evaluate your criminal history before evaluating your qualifications. If you have a criminal history, a prospective employer is no longer legally allowed to ask you about your previous run-ins with the law, at least not until they have determined that you are qualified for the position to which you are applying.
