Who Is Eligible for FMLA and CFRA Protections?
To be eligible for FMLA or CFRA coverage, you must be a full-time or part-time employee, have worked for your current employer for at least 12 months, and have worked at least 1,250 hours within the 12 months leading up to the start of your leave. The FMLA only applies to people who meet these criteria and work for a company with at least 50 employees within a 75-mile radius. In contrast, the CFRA applies to employees of companies with five or more employees anywhere in the state.
As our attorneys could further explain, the FMLA allows covered employees in Bakersfield to take protected leave to care for a newborn child, an immediate family member diagnosed with a serious health problem, or for their own serious health problem. Conversely, the CFRA allows you to take protected leave to care for a domestic partner or other designated person’s serious health problem, as well as for your own health problems or those of an immediate family member. However, it does not cover leave for pregnancy, childbirth, or related medical concerns.
