    Los Angeles Scooter Accident Lawyer

Helping victims obtain the compensation they deserve.

Rental electric scooters, such as those offered by Bird and Lime, provide an eco-friendly and quick alternative to traditional modes of transportation. Using a phone app, you can locate a nearby scooter, unlock it, and ride it to your destination. Although they are convenient, the scooters pose potential risks to riders, pedestrians, bicyclists, and drivers who share the same space. Mechanical defects, road hazards, and/or distracted drivers can all cause accidents that could result in serious injury.

If you were in an accident involving an electric scooter, whether you were riding it or collided with someone who was, our personal injury attorneys at LNN will provide legal representation to guide you through the complicated process of filing a claim against the responsible party. We have decades of combined legal experience and have successfully recovered millions of dollars for accident victims. Our Los Angeles scooter accident lawyers will be committed to helping you obtain the compensation you deserve.

    State ELECTRIC SCOOTER LAWS

Bird and Lime scooters fall under California Vehicle Code § 21225, which governs motorized or electric scooters.

According to VC § 21225, riders must follow these rules in order to operate an electric scooter:

    • Have a valid driver’s license or permit
    • Use the bike lane (riders are prohibited from riding on the sidewalk)
    • Wear a fitted helmet regardless of age
    • Park the scooter away from pedestrian traffic, including sidewalks or walkways.
    • Do not carry packages or objects that prevent the rider from having at least one hand on the handlebars.
    • Do not exceed the speed limit of 15 miles per hour.
    • Do not ride with more than one person on the scooter
    • Do not attach the scooter to another vehicle.

If you were injured by a Bird or Lime rider who failed to follow the law, contact our Los Angeles attorneys for more information to how to seek compensation.

    UNDERSTANDING LIABILITY IN SCOOTER ACCIDENTS

Because many different factors can cause accidents, various parties can be held liable, including scooter riders, others on the road, or the scooter company or manufacturer. To recover compensation for losses, you must prove that the at-fault party’s negligence resulted in an accident.

Our Los Angeles electric scooter attorneys have extensive experience assessing accidents and can thoroughly investigate your case to determine liability and seek maximum compensation on your behalf.

WHO CAN BE HELD LIABLE IN AN E-SCOOTER ACCIDENT?

There are numerous different parties that can be held accountable after an accident for the damages that occur. Some of the parties include:

    • Rider – If a pedestrian is hit by a scooter, the rider is likely at fault for the damages if negligence is deemed to be the cause. Some of the types of negligence would be:
      • Speeding
      • Failure to brake
      • Distracted riding
    • Driver of the motor vehicle – In the case of an accident between a motor vehicle and an e-scooter, the driver can be held liable if he or she is found to have been driving in a negligence fashion.
    • E-scooter company – In the case of a faulty device, the company that manufactured the scooter can be found liable.
    • Pedestrian – If the accident was the result of a pedestrian’s negligence, such as walking while distracted while looking at their phone, they may be held liable.

If you need assistance knowing who to file a claim against, our team can help you hold the faulty party liable.

    COMMON CAUSES OF ACCIDENTS

Electric scooters can travel up to 15 mph, which can be dangerous when the rider is navigating California’s crowded streets. Any number of factors could result in an accident. The most common causes of electric scooter accidents include:

    • Unsafe use by riders: using scooters on sidewalks instead of bike lanes, riding with multiple people on one scooter, using scooters in prohibited areas
    • Mechanical failures: brake malfunctions, defective batteries, wheel locks, loose handlebars
    • Road hazards: potholes, raised ground, water on roads, construction zones
    • Pedestrian/bike/vehicle collisions: attempting to avoid scooter riders, distracted driving
    • Improperly stored scooters: trips and falls over scooters left on walkways, in front of buildings, or in vehicle parking spots

No matter the cause of a scooter accident, a lawyer in Los Angeles could help determine eligibility for a lawsuit.

What to Do after an Accident

If you have been injured in a scooter accident that was caused by another driver’s negligence, your situation will be specific to you. This said, however, there are important steps that everyone in your position should take.

Seek the Medical Attention You Need

The most important order of business after a scooter accident is prioritizing your health and well-being. After moving out of the line of traffic, you should call 911 and accept the emergency medical care and transportation offered at the scene.

If you do not receive medical care at the scene, you should get checked out by your medical provider as soon after the accident as possible. The bottom line is that very serious injuries can be asymptomatic early on, and the adrenaline rush and shock you experience can mask serious symptoms.

Early diagnosis and treatment of injuries are so closely associated with improved health outcomes that it is always advisable to get checked out after an accident. It is also important to carefully adhere to your medical team’s guidance and instructions, which includes attending all follow-up appointments.

Finally, it is against the law to leave the scene of an accident. And doing so is not in the best interest of your claim or your recovery.

Be Mindful of What You Say

The less you say at the scene of an accident, the better. While you should answer the basic questions put to you by the police as succinctly and truthfully as possible, you should limit what you say beyond this.

It is only normal to be rattled following an accident, and it is also human nature to express regret. However, saying that you are sorry at this juncture – even in a very general sense – can come back to haunt your claim.

The truth is that the insurance company that handles your claim is in the business of making money, and they will take every advantage they can in their efforts to do so. This includes carefully considering all your remarks and, wherever possible, shaping their meaning to something that weakens your claim. It is a good idea to stay off social media while your claim is pending for exactly the same reason.

The sooner you have our skilled Los Angeles attorneys backing you up after a scooter accident, the better protected your rights and your rightful compensation will be.

    Why Hire an Attorney

There are many good reasons for hiring a seasoned Los Angeles scooter accident lawyer.

There Is No Reason to Hesitate in Relation to Cost

After a scooter accident, you are likely facing mounting medical bills as well as a decrease in earnings, and the cost of hiring an attorney may give you pause. The good news is that most scooter accident lawyers work on contingency, which means you will not owe anything until your claim is resolved. Only if you receive a settlement or court award will your legal counsel receive a prearranged percentage.

We Are Well Prepared to Skillfully Navigate the Legal Intricacies Ahead

Scooter accident claims are legally challenging, and accurately assessing the compensation you deserve as well as obtaining it requires legal insight and skill. Your knowledgeable lawyer will leave no stone unturned in their efforts on your behalf, and they have the experience, resources, and drive to back this up.

In the end, having a savvy attorney on your side can make a difference in terms of how your claim is resolved. This can translate to receiving just compensation that covers your full range of losses, which is key to your recovery.

    FREQUENTLY ASKED QUESTIONS

Personal injury cases are some of the most common civil litigation cases—also known as “tort actions” or “lawsuits”—in the United States. They are filed by individuals who have experienced bodily injury, pain and suffering, and sometimes property damage in an accident caused by a negligent third party. These claims can also be filed for intentional harm or defamation of character by a third party.
While you are not required to have an attorney to file a claim, having an attorney can make a significant difference in your claim. A personal injury attorney has a deep understanding of the claims process and can help you navigate the complexities of the law. Your attorney can also help you level the playing field with insurers and can tell you whether you are receiving the maximum compensation to which you are legally entitled.
If you have been injured in an accident that was no fault of your own, there are steps you should take to ensure you are compensated for costs related to the incident. Taking quick action after your accident can profoundly affect your personal injury claim or lawsuit. After being involved in an accident, you should: Seek medical attention for your injuries, even if symptoms are not immediately apparent. Keep a record of your injuries and note any complications that arise because of your injuries. Report the incident as soon as possible after it occurs. Record detailed descriptions and notes about the facts of the incident. Keep receipts of medication and medical care you received Contact an experienced personal injury attorney in Los Angeles who can help you navigate your claim.
Not all personal injury claims make it to court. In fact, a majority of injury cases are settled without having to litigate. What’s the difference between a settlement and going to trial? What are the pros and cons of each? There are two ways in which compensation can be awarded to you for your claim: through a settlement or by going to trial. There are pros and cons to each. When your claim is settled, the compensation for your claim is decided outside of court, usually through negotiations between lawyers.
In California, you have two years to file a personal injury claim against an individual or non-government entity. If the injury is not immediately known, you have one year from the date the injury is discovered. If you’ve suffered injuries from an accident that was caused by someone else’s negligence, you should act quickly to ensure you are able to recover compensation for your losses.

    Notifying Insurance Companies

You should notify your insurance company and the responsible party’s insurance company as soon as possible after your accident. Most insurance companies request that you file your claim within 24 – 48 hours after your accident. When you file a personal injury insurance claim, you are requesting that the at-fault party’s insurance pay for the losses you suffered as a result of your accident, and the compensation amount is determined during negotiations. Seeking Compensation You can get financial compensation in two ways: filing a personal injury insurance claim or filing a personal injury lawsuit. Generally, compensation can be sought for two types of damages: economic and non-economic. Economic damages are those with a measurable monetary value, such as medical expenses and lost wages. On the other hand, non-economic damages refer to losses that cannot be easily quantified, such as pain and suffering or emotional distress. It is important to understand the types of damages available in your case so that you can seek compensation for all of your related losses. Soon after your accident, contact a knowledgeable personal injury attorney in Los Angeles who can explain the time limits to you and help you get the compensation you deserve.
